EL SUPREMO CONDENA A PRISIÓN A LOS RESPONSABLES DE UN CLUB DE CANNABIS POR DELITO CONTRA LA SALUD PÚBLICA

El Tribunal Supremo ha condenado al presidente, al secretario y al tesorero de la asociación Three Monkeys España a ocho meses de prisión a cada uno por un delito contra la salud pública. La Sala de lo Penal estima así parcialmente el recurso del Ministerio Fiscal y anula la sentencia de la Audiencia Provincial de Barcelona que les absolvió de los delitos de asociación ilícita y contra la salud pública.

La sentencia anulada decía que los hechos declarados probados no constituyen delito porque en el local de la Asociación no se vendía indiscriminadamente la marihuana y el hachís, sino que exclusivamente se vendía a los socios y que, por otra parte, no les guiaba el ánimo de lucro.

La Sala de lo Penal afirma que en el supuesto analizado “un reducido núcleo de personas organiza y dirige la estructura asociativa. Disponen y preparan toda la intendencia, abastecimiento, distribución, control, cultivo, y ponen tales estructuras al servicio de un grupo amplio e indiscriminado de usuarios que se limitan a obtener la sustancia previo pago de su cuota y de su coste”. Eso, subraya la sentencia, es facilitar el consumo de terceros y, además, hay distribuidores frente a simples consumidores receptores.

De acuerdo con el caso resuelto en sentencia por el Pleno Jurisdiccional el pasado 8 de julio, reitera que la actividad desarrollada por los clubs sociales de cannabis, asociaciones, grupos organizados o similares no será delito cuando consista en proporcionar información, elaborar o difundir estudios, realizar propuestas, expresar de cualquier forma opiniones sobre la materia, promover tertulias o reuniones o seminarios sobre esas cuestiones.

La sentencia señala que sí traspasa las fronteras penales la conducta concretada en organizar un sistema de cultivo, acopio, o adquisición de marihuana o cualquier otra droga tóxica o estupefaciente o sustancia psicotrópica con la finalidad de repartirla o entregarla a terceras personas, aunque a los adquirientes se les imponga el requisito de haberse incorporado previamente a una lista, a un club o a una asociación o grupo similar; también cuando la economía se limite a cubrir costes.

Asimismo, la Sala Segunda argumenta que no se trata de imputar a los responsables de la asociación el mal uso por parte algunos socios o el incumplimiento de sus compromisos o el hecho de que un socio haya entregado a persona no consumidora parte de la sustancia; o si la vende traicionando sus obligaciones asociativas.

Sin embargo, indica que “sí son responsables de crear la fuente de esos riesgos incontrolables y reales cuando se manejan esas cantidades de sustancia que se distribuyen a 290 personas cuyas actitudes o motivaciones no pueden fiscalizarse”.
Asimismo, destaca que “no puede convertirse una asociación de esa naturaleza en una suerte de cooperativa de distribución de la sustancia estupefaciente prohibida”.

La sentencia de la Sala de lo Penal incluye un voto particular del magistrado Joaquín Jiménez, partidario de absolver a los responsables de ‘Three Monkeys España’ por no existir dolo en su conducta.
