El Tribunal Supremo ve delictivo cultivar y fumar cannabis en los clubs

“El cultivo y distribución organizada, institucionalizada y con vocación de persistencia en el tiempo de cannabis entre un colectivo integrado por 290 personas componentes de una asociación” constituye tráfico de drogas, según la doctrina establecida por el Supremo en una sentencia conocida hoy.


El alto tribunal considera que “el cultivo compartido de cannabis destinado al consumo exclusivo y excluyente de quienes promueven esa producción a escala reducida, aún siendo actividad no legal, puede carecer de relevancia penal en determinadas condiciones”.

Sin embargo, dice también el tribunal, si este intercambio se realiza entre los cientos de personas que integran una asociación abierta a nuevas incorporaciones, entonces encaja perfectamente en lo que el Código Penal califica de delito contra la salud pública o tráfico de drogas. Este delito se castiga en el artículo 368 con penas de prisión de tres a seis años y multa.

El artículo castiga a “los que ejecuten actos de cultivo, elaboración o tráfico, o de otro modo promuevan, favorezcan o faciliten el consumo ilegal de drogas tóxicas, estupefacientes o sustancias psicotrópicas, o las posean con aquellos fines”.

La doctrina del Supremo se establece en una sentencia cuyo fallo se conoció el pasado mes de julio y cuyos fundamentos jurídicos han sido divulgados ahora.

El Pleno de la Sala de lo Penal del Tribunal Supremo condenó por delito contra la salud pública a los responsables una asociación de consumidores de cannabis de Bizkaia al apreciar que no les es aplicable la doctrina del autoconsumo compartido como eximente.

Los magistrados acogieron de este modo el recurso que presentó la Fiscalía contra una sentencia de la Audiencia Provincial de Bizkaia que absolvió a los responsables de la asociación.

La Audiencia Provincial había estimado que los hechos carecían de relevancia penal al estar comprendidos en la doctrina del autoconsumo compartido, proclamada tiempo atrás por el propio Tribunal Supremo.

Ahora el Supremo pone coto a la aplicación de esa eximente y aclara que no es posible aplicársela a la Asociación de Estudios y Usuarios del Cáñamo Ebers, de 290 miembros, aunque la condena se aplica a sus cinco dirigentes.
