PARLAMENTO VASCO APRUEBA REGULAR CLUBES SOCIALES DE CANNABIS

Todos los grupos del Parlamento vasco -PP, PNV, PSE, EA, Aralar, Ezker Batua y UPyD- han presentado una Proposición no de Ley relativa a la regulación del consumo de cannabis, en la que sugieren la creación, durante el primer periodo de sesiones de 2012, de una ponencia específica para el análisis de una solución regulada de la actividad de los denominados Clubes Sociales de Cannabis.

La semana pasada, el Departamento de Sanidad del Gobierno vasco anunció que se encontraba trabajando en una nueva regulación sobre el cannabis, a través de una Ley de Adicciones.

Posteriormente, precisó que “en ningún momento” se había planteado “la legalización ni la permisividad” respecto al consumo de la marihuana, sino “establecer una regulación orientada a evitar el tráfico ilícito, la protección de los menores, la prevención de la salud y dar un soporte normativo al autoconsumo y al autocultivo de una forma responsable”.

Los grupos parlamentarios han justificado la Proposición no de Ley que han presentado con el hecho de que, dado que la legislación no sanciona el consumo de cannabis, sino su venta y cultivo cuando éste está destinado al tráfico, en los últim os años se han constituido en Euskadi varias asociaciones de usuarios de cannabis, las cuales permiten a sus integrantes un consumo regulado y evitar así el mercado negro.

“Necesario” corregir

No obstante, la ausencia de una regulación de su actividad hace que esas asociaciones se muevan en la alegalidad y carezcan de seguridad jurídica, una situación que los grupos parlamentarios han considerado que es “necesario” corregir mediante la regulación legislativa del cultivo de cannabis para consumo propio desde el respeto a la autonomía personal y al derecho de las personas no fumadoras, y a partir de una información completa sobre las consecuencias del uso de la marihuana.

Por ello, todos los grupos del Parlamento vasco han propuesto la creación de una ponencia para buscar una solución regulada a la actividad de las asociaciones de consumidores de cannabis.

Dicha ponencia estará abierta a la participación de las instituciones públicas implicadas en esa regulación y de expertos en la materia, al objeto de definir un marco de estabilidad y seguridad jurídica de los citados clubes sociales en el desarrollo de su actividad.
