LOS CLUBES SOCIALES DE CANNABIS EN ESPAÑA UNA ALTERNATIVA NORMALIZADORA EN MARCHA

Los Clubes Sociales de Cannabis (CSC) son asociaciones de personas usuarias que se organizan para autoabastecerse sin recurrir al mercado negro. Se basan en el hecho de que el simple consumo de drogas ilícitas no ha sido nunca un delito en la legislación española. Aprovechando ese hueco legal, desde hace años existen clubes privados que producen cannabis para su distribución sin ánimo de lucro en un circuito cerrado de adultos previamente usuarios.

Desde su aparición, alrededor de 2002, los CSC han permitido que varios miles de personas dejen de financiar el mercado negro y conozcan la calidad y origen de lo que consumen, generando puestos de trabajo y recaudación de impuestos, y todo ello sin necesidad de denunciar los tratados de la ONU sobre drogas.

El presente trabajo resume la naturaleza y forma de funcionamiento de dichos clubes, planteando además un debate acerca de la conveniencia de dejar de lado la defensa de modelos alternativos de regulación basados en la creación de un circuito comercial abierto, similar al del alcohol o el tabaco, optando en cambio por un modelo consumerista y no lucrativo, que evita muchos de los riesgos inherentes a un mercado dominado por la búsqueda de beneficios económicos.

Conclusiones & Recomendaciones

* En España, desde la aparición de los clubes sociales de cannabis (CSC) en 2002, miles de personas logran abastecerse de forma legal de marihuana ejerciendo control sobre su calidad, para su consumo personal.

* Aprovechándose de un hueco jurídico existente en la legislación española, y a través de un sistema de registro legal de grupos de consumidores y un cultivo colectivo, los clubes se perfilaron de forma creciente en todo el país.

* El boom de los clubes se dio luego de varias sentencias del Tribunal Supremo, que definieron el ámbito de cultivo para uso personal ya no como un delito, por no estar dirigido al tráfico.

* Es hora de que el debate sobre políticas de drogas se distancie de la simplificación de legalización o prohibición, y se consideren formas alternativas para enfrentar el fenómeno de las drogas.
