Proyectan que Ministerio de Salud fije la cantidad máxima para consumo

El proyecto de Ley de Sustancias Controladas y Delitos Conexos plantea, entre otros puntos, que el Ministerio de Salud establezca la cantidad máxima de droga que debe tener una persona para su consumo, de manera que se evite que vaya a purgar condenas de hasta 25 años al ser encontrada con una cantidad mínima, como señala la Ley 1008.

“Se está planteando que el Ministerio de Salud, como instancia competente, establezca los márgenes del consumo personal, o sea, la cantidad máxima que debe tener una persona para consumo personal, discriminando los tipos de estupefacientes y de sustancias psicotrópicas”, dijo Iván Morales, consultor de dicho proyecto.

En el marco del “Taller de Validación” del proyecto, que se realizó ayer con autoridades policiales y gubernamentales ligadas al tema del narcotráfico, Morales hizo notar que hubo y hay casos de gente que fue encontrada con ocho gramos de cocaína que era para consumo personal y está purgando sanciones de entre 15 y 25 años de cárcel, ya que “la Ley 1008 no discrimina si es un gramo, dos o un kilo o una tonelada”.

Sólo las autoridades del Ministerio de Salud tendrían la potestad de fijar las cantidades máximas para consumo personal; de todas maneras, en el proyecto de ley se plantea que los “consumidores” sean sometidos a procesos de rehabilitación médica y social ante las instancias competentes. Actualmente, el artículo 48 de la Ley 1008 señala de 10 a 25 años de cárcel para el tráfico de drogas.

El Art. 49 refiere que “el dependiente y el consumidor no habitual que fuere sorprendido en posesión de sustancias controladas en cantidades mínimas que se supone son para su consumo (…) será internado en un instituto de farmacodependencia público o privado para su tratamiento…”. La cantidad mínima la fijan profesionales en farmacodependencia y si la tenencia es mayor a la que “necesitaría” se aplica el artículo 48.
