COMUNICADO DE ORGANIZACIONES CANNÁBICAS EN ARGENTINA

Las organizaciones de usuarios y cultivadores de cannabis de Argentina, celebramos el avance del debate por la reforma de la ley 23.737 en la Cámara de Diputados de la Nación y pedimos nuevamente que la misma nos garantice a quienes usamos cannabis y lo cultivamos en nuestras casas, no ser más detenidos ni procesados penalmente hasta que logramos demostrar que lo que cultivamos y tenemos es para nuestro consumo.

En este sentido, y si bien no dejamos de pedir por la regulación total del acceso al cannabis para sus diversos usos, hacemos público nuestro apoyo al proyecto de reforma acordado por los diputados Diana Conti (FpV), Ricardo Gil Lavedra (UCR) y Victoria Donda (FAP), en la medida en la que especifique claramente en los incisos A y B del artículo 5 -de la actual ley- que el único cultivo penalizado es aquel “con fines de comercio”, y así nos brinden la garantía de que no allanarán nuestros domicilios ni nos llevarán detenidos por tener o cultivar nuestra marihuana si primero no tienen pruebas de comercio.

Esta modificación no es menor, ya que de continuar penalizando abiertamente el cultivo -más allá de su finalidad- y despenalizándolo recién cuando surge que es para consumo personal, la ley seguirá promoviendo que allanen nuestras casas, nos detengan y nos procesen penalmente violando nuestros derechos, arruinando nuestras familias y futuro.

Asimismo, celebramos que en dicho acuerdo se termine con la criminalización del consumo en la vía pública (artículo 12) y se revierta la carga probatoria a la hora de penalizar la simple tenencia de drogas (artículo 14), exigiendo a los jueces y fiscales que cumplan con su trabajo, es decir, reunir pruebas de un fin distinto al consumo antes de detenernos por tener drogas. También creemos que es un avance la despenalización de la tenencia de las semillas que nos permiten llevar adelante el autocultivo, aunque no dejamos de señalar que aún queda pendiente la regulación del acceso a las mismas.

Como organizaciones que defendemos los derechos hoy violados de un sector de la sociedad, pedimos que el Estado asuma su deber de trabajar para demostrar la existencia de un delito y deje de obligarnos a los ciudadanos a tener que demostrar nuestra inocencia con la excusa de la ineficiencia de las fuerzas policiales para reunir las pruebas de comercio que les corresponde. Somos ciudadanos usuarios de cannabis que reclamamos nuestro derecho de tener y cultivar la marihuana que consumimos sin que el Estado nos criminalicen por ello.
