1. Parlamentarische Bürgerinitiative zur Herausnahme von Cannabis aus dem Suchtmittelgesetz gestartet

Am Mittwoch wurde die erste österreichische parlamentarische Bürgerinitiative betreffend die „Herausnahme von Cannabis aus dem Österreichischen Suchtmittelgesetz“ eingebracht. Mit parlamentarischen Bürgerinitiativen können österreichische StaatsbürgerInnen direkt Anliegen an den Nationalrat herantragen.

Die vom Obmann des Vereins Legalize! Österreich, Bernhard Amann gestartete Initiative wird vom Hanf-Institut unterstützt.

Kernpunkte der Initiative sind unter anderem die Legalisierung des Eigenanbaus für den persönlichen Verbrauch. Wer mehr als für seinen persönlichen Konsum produzieren will, muss um eine staatliche Lizenz ansuchen und eine Steuer von ein bis zwei Euro je Gramm an den Staat abführen, schlägt die Bürgerinitiative vor. Die Erzeugerlizenz muss dem Vorhaben zufolge ab einer Produktionsmenge von 500 Gramm Cannabis pro Jahr eingeholt werden.

Der Besitz von 10 Gramm Cannabis soll generell straffrei werden.

Mit dem Erreichen des Wahlalters soll der Cannabiserwerb und -besitz erlaubt werden, analog zu leichten Alkoholika und Nikotin.

Die Abgabe soll bestehende Strukturen nützen und über Trafiken, Apotheken und andere lizensierte Abgabestellen erfolgen.

Mit dieser Massnahme seien auch grosse Ersparnisse in der Strafverfolgung von Cannabis-Delikten zu erwarten, die Amann mit rund 100 Millionen Euro jährlich bezifferte.

Zum heiß diskutierten Thema Cannabis und Strassenverkehr will Amann den § 5 Abs 1 Satz 3 StVO einführen, wobei er einen Grenzwert von 10 Nanogramm THC, dem psychoaktiven Wirkstoff in der Cannabis-Pflanze, je Milliliter Blut für realistisch hält. Zum Vergleich: Snowboarder dürfen bei internationalen Wettbewerben bis zu 150 Nanogramm je Milliliter aufweisen.

Die Unterstützer hoffen bei rund einer Million österreichischer Cannabis-Konsumenten auf eine sehr hohe Beteiligung.
