LA CORTE SUPREMA OLANDESE ASSOLVE UN PAZIENTE DI SCLEROSI MULTIPLA PER COLTIVAZIONE DI CANNABIS

L’AIA (AFP) —La Corte Suprema olandese martedì scorso ha confermato un’importante sentenza di una Corte d’appello che rendeva legale per un paziente malato di sclerosi multipla coltivare cannabis per uso terapeutico.

Confermando la sentenza di Ottobre 2006, la Suprema Corte afferma che “circostanze eccezionali” possono determinare che un “un atto illegale possa essere giustificato se commesso per necessità”

“Lo stato di necessità è dimostrato”, ha aggiunto.

Il verdetto fa seguito della decisione del pubblico Ministero di cambiare la sentenza della corte d’appello che autorizzava a un malato di sclerosi multipla Vim Moorlag e a sua moglie Klasiena Hooijers di coltivare cannabis per alleviare i suoi sintomi.

Secondo il governo olandese, la sentenza segna un precedente che mette in crisi la tollerante politica nazionale sull’uso della cannabis. La vendita e il consumo di piccole quantità di cannabis sono permesse in coffee shop autorizzati.

Moorlag e sua moglie, che avevano coltivato cannabis per uso personale, erano stati condannati a 250 euro di multa in primo grado nel 2004.

Il malato di Sclerosi multipla, che ha bisogno di 3 grammi al giorno di cannabis, ha detto subito alle autorità che era costretto a prodursi la propria cannabis.

La Cannabis che si compra nei coffe shop, ha sostenuto, può contenere funghi e batteri particolarmente dannosi per i malati di Sclerosi multipla .

Dopo la sentenza della Corte d’appello del 2006 l’avvocato di Moorlag affermò che la decisione significava che anche altri pazienti come persone malate di AIDS avrebbero potuto coltivarsi legalmente la loro cannabis.

I cittadini olandesi possono legalmente acquistare 5 grammi di cannabis al giorno e possedere fino a 30 grammi per il loro uso personale senza essere perseguiti. Ma coltivare o vendere cannabis è comunque illegale.
