LEGAL SITUATION OF CANNABIS IN CZECH REPUBLIC
1. Cannabis use (recreational and /or medicinal)
On the 1st of January 2010 a new Penal Code a Decree for a closer definition on the types and quantities of narcotics and psychotropic substances (OPL) came into effect. According to the new legislation unauthorized possession of drugs for personal use is illegal and punishable in every situation. When is concerns a small amount it falls under the Law on misdemeanors. Under this law Cannabis possession may be punished similarly to other drugs, with a maximum fine of 15 000 CZK. In larger quantities the violation falls under the Criminal Code. Under this code violators may be punished with a maximum imprisonment sentence of one year and forfeiture of assets. The Act defines certain entities, which are allowed to retain the drug. These entities include: medical facilities, pharmacies and laboratories, among others. Anyone who is not mentioned as an exception is acting unlawfully when possessing Cannabis.
2. Cultivation
Unauthorized cultivation of plants or fungi containing drugs for personal use id illegal and punishable at all times. IN small quantities it falls under the law of misdemeanors and in larger quantities it falls under the criminal code. Under the law of misdemeanors it may be an infringement procedure with a fine up to 15000 CZK. Under the criminal code people may be imprisoned for up to six months, have a pecuniary penalty or forfeiture of other assets. For both possession and cultivation the government considers up to 15g of dried buds or 5 g hash as a small amount, for cultivation it’s 5 female plants.
3. Distribution
The law which deals with Cannabis and hallucinogenic fungi only applies to possession and cultivation for personal use in both small and larger quantities. Anything else related to Cannabis, such as sale, import, export, etc. is punished in the same way as any other drug.
4. Provision of seeds, tools to produce and consume cannabis with etc.
It is legal to sell and buy cannabis seeds as well as all equipment for cultivation or using cannabis. All products containg more than 0.3% of THC are illegal.
5. Production and distribution of hemp products.
Sale and distribution of hemp products made of fiber or seeds is permitted. Production of goods made from cannabis flower tops (extracts, essence with less than 0,3% THC) is not permitted by law but it is tolerated. Hemp products are widely available in health food stores, e-shops and even in some supermarkets.
