El Tribunal Constitucional italiano revoca la ley antidrogas

ROMA – El Tribunal Constitucional italiano ha revocado este miércoles la ley sobre drogas que triplicaba la pena para aquellos condenados por posesión o consumo de ‘drogas blandas’ como el cannabis. La normativa era considerada una de las causas de la superpoblación de las cárceles del país.

La denominada ley Fini-Giovanardi equiparaba el uso, posesión, o venta de todas las drogas, ya fuesen duras o blandas, por lo que una persona acusada de vender hachís podía ser condenada a entre seis y veinte años de prisión o a pagar una multa de entre 26.000 y 260.000 euros, según ha informado el diario italiano ‘La Reppublica’.

Tras la revocación de la norma, se volverá a la ley del año 1993, que prevé condenas más bajas para las drogas blandas. A partir de ahora, una persona acusada de vender hachís podrá ser condenada a entre dos y seis años de cárcel como máximo.

La decisión del Constitucional afectará a unos 10.000 detenidos, entre los que están a espera de juicio y los condenados de forma definitiva, que con la nueva normativa podrán ser puestos en libertad.

Esta ley había sido señalada como responsable de la superpoblación de las cárceles italianas, que cuenta con unos 65.000 reclusos cuando tiene capacidad para unos 45.000. Además, el 40 por ciento de ellos son condenados por delitos relacionados con drogas.

La decisión ha sido aplaudida por las formaciones de centroizquierda y en especial por la exministra de Salud Livia Turco. “Finalmente se hace justicia con una ley malvada que ha llevado a miles de jóvenes a cruzar el umbral de la cárcel o a ser víctimas de un procesamiento penal por haber fumado un porro”, ha afirmado.

Sin embargo, el senador de Nuevo Centroderecha Carlo Giovanardi, uno de los artífices de la norma, ha criticado que con esta decisión “el tribunal envía el mensaje erróneo a los jóvenes de que algunas drogas son menos peligrosas que otras”. También ha acusado al tribunal de haber adoptado su decisión en base a una campaña promocional”.
