Cataluña regula los Clubes Sociales de Cannabis

La iniciativa legislativa popular presentada en 2015 por los agentes sociales fue aprobada por una mayoría amplia en el Parlamento Catalán.

Esta ley ha sido fruto de mucho esfuerzo por parte de agentes sociales, expertos y políticos. Se presentó en forma de Iniciativa Legislativa Popular y consiguió 67.500 firmas, de las cuales fueron aceptadas unas 55.000.

Posteriormente se abrió un periodo de enmiendas en el que también participaron las Federaciones catalanas, Fedcac y CatFAC (Som el que cultivem) y los expertos a través de los partidos políticos.

El pasado miércoles, después de un periodo de dos años, la ILP Rosa Verda, fue aprobada por una mayoría amplia de los grupos parlamentarios catalanes. Con los votos a favor de JxSí, Cs, PSC, CSQP i CUP; es decir todos los grupos parlamentarios excepto PPC que votó en contra.

Pero, ¿qué dice en detalle la ley? ¿cómo es el modelo de club social de cannabis catalán? La ley regula los Clubes Sociales de Cannabis en el marco de la ley de asociaciones y la doctrina jurídica del consumo y cultivo colectivos. Establece que estas entidades sean sin ánimo de lucro, con una gestión democrática, asamblearia y transparente.

En cuanto a la prevención de riesgos y la salud colectiva, lo que ha guiado la ley desde sus inicios, con el asesoramiento de la Subdirección de Drogodependencias de la Generalitat de Catalunya, que continúa siendo pionera en programas de prevención efectivos, y la Agencia de Salud Pública catalana, se describe al modelo CSC como un modelo que preserva los valores de la prevención de riesgos y un importante agente para la correcta gestión de placeres de un modo responsable de las personas usuarias de cannabis. También se obligará a las asociaciones a hacer una trazabilidad del producto, incluyendo un análisis del cannabis, al final del proceso y previo a su distribución. No se podrá consumir alcohol ni drogas ilegales en los CSC, ni se podrá hacer apología o publicidad del consumo de cannabis.

Por otro lado, encontramos la transparencia, la ley obliga a tener libros de registro de miembros, actas, cultivos, retiradas y contabilidad, así como un peritaje agrícola.

En definitiva, es un modelo seguro para personas usuarias y no usuarias, que contempla la realidad social. La ley está basada en la Salud y en los Derechos Humanos, desde una perspectiva multidisciplinar y regula de forma integral los Clubes Sociales de Cannabis.
