EUSKADI RETOMA LA REGULACION DE LOS CLUBES DE CANNABIS

Una ponencia que se pondrá en marcha antes del verano recuperará los
trabajos de la legislatura anterior que quedaron inacabados.


VITORIA | EFE | El Parlamento Vasco volverá a intentar regular esta
legislatura la actividad de los clubes sociales de cannabis en Euskadi a
través de una ponencia específica que se pondrá en marcha antes del
verano y que recuperará los trabajos de la legislatura anterior que
quedaron inacabados.

La Comisión de Salud y Consumo ha aprobado hoy por unanimidad de los
grupos, salvo UPyD que no estaba, la constitución de una ponencia que dé
continuidad a los trabajos que comenzaron en la anterior legislatura
para buscar una solución regulada a la actividad de estos clubes.

Carmelo Barrio (PP) ha sido quien ha propuesto recuperar los
“interesantes” trabajos de la pasada legislatura en torno a esta
ponencia y analizar también el consumo del cannabis con la presencia de
más expertos, científicos y representantes sociales.

En la legislatura anterior comparecieron 12 expertos, entre ellos el
delegado del Gobierno central para el Plan Nacional sobre Drogas,
Francisco de Asís Babín, quien opinó que el Parlamento y el Ejecutivo
vascos tienen “muy poco” margen de maniobra para poder legislar sobre
los clubes de cannabis, si éstos se dedican al cultivo colectivo de drogas.

No obstante, sí que consideró que es posible adecuar espacios de
carácter privado en los que las personas puedan consumir cannabis con
las restricciones jurídicas correspondientes.

En lugar de la iniciativa del PP, que PNV, EH Bildu y PSE-EE han
considerado demasiado genérica, estos grupos han aprobado con el apoyo
también del PP una enmienda a la totalidad en la que tratan de poner una
fecha a la constitución de la ponencia y dicen que deberá constituirse
durante el primer período de sesiones, es decir, antes del verano.

Asimismo, la iniciativa plantea que los trabajos que se retomen deben ir
dirigidos a buscar una solución regulada de la actividad de los
denominados clubes sociales de cannabis.

Luis Javier Telleria (PNV) ha opinado que los trabajos de la ponencia
deberían concluir esta legislatura con el fin de que se pueda legislar
“algo que hoy por hoy es alegal”.

Todos los grupos de la Cámara apoyaron la pasada legislatura la
constitución de esta ponencia cuyo objetivo era definir un marco
jurídico que regule la actividad de las asociaciones de usuarios de
cannabis constituidas en Euskadi y corregir la situación de vacío legal
en la que se mueven.

El objetivo inicial era buscar una regulación legislativa del cultivo de
cannabis para consumo propio que tuviera en cuenta el respeto a la
autonomía personal y el derecho de las personas no fumadoras, y que
garantizase una información completa sobre las consecuencias en la salud
de esta sustancia.

El País Vasco es una de las zonas de Europa con mayor uso de cannabis,
una sustancia cuyo consumo individual no está sancionado, pero sí la
venta y cultivo si está destinado al tráfico.
